“This is an abuse of power” – Minority slams EOCO over attempted arrest of Manhyia South MP

Private legal practitioner Martin Kpebu has expressed concern over what he sees as a "retrogression" in Ghana's democracy following the alleged attempted arrest of Manhyia South MP Nana Agyei Baffour Awuah by security personnel. The incident occurred at the Accra High Court on September 23, when lawyers for detained nurse Salomey Baffoe Awiti reportedly confronted security officers, leading to a scuffle.

In a video that has gone viral, a woman believed to be a security officer is seen trying to prevent the MP from entering a car, resulting in a confrontation with a heavily built man who opened the car door to allow the MP to drive away. Another vehicle, possibly belonging to the security personnel, can be seen following the MP's car.

While the exact nature and intent of the security personnel's actions remain uncertain, Martin Kpebu criticized the manner in which the incident unfolded. According to him, the pursuit of the alleged arrest by security officers rather than following proper parliamentary procedures represents a setback for democratic practices in Ghana.

Kpebu pointed out that under the Parliament Act 300 and the constitutional framework, the Speaker of Parliament should be involved when an MP is required by law enforcement authorities, and arrangements should be made for the legislator to appear at a suitable time. He emphasized that such procedures are crucial in preventing the misuse of state institutions by the government against opposition MPs.

Kpebu urged political parties to remain vigilant about the potential misuse of state institutions and to ensure that power dynamics do not remain entrenched in favor of the ruling party. He highlighted the importance of a two-way cycle in Ghana's democracy, reminding that no party can hold office indefinitely. The comments come as lawyers for Salomey Baffoe Awiti continue their efforts to secure her release from custody, with the High Court having adjourned her bail application hearing until September 24.
