South Africa submits filing to ICJ over Israel’s non-compliance with its rulings

In a recent development, South Africa has filed a detailed report with the International Court of Justice (ICJ) over Israel's non-compliance with previous provisional measures. These measures, issued by the ICJ in 2024, compel Israel to cease actions prohibited by the Genocide Convention (EPA Images pic). The filing, reported by Syrian Arab News Agency (SANA), was submitted under Article 11 of the court's resolution regarding its internal judicial practices.

According to South Africa's Department of International Relations and Cooperation, the ICJ's provisional measures, which were directed at Israel in 2023, are legally binding. The department emphasized that Israel has not adhered to these orders, leading to ongoing humanitarian crises. Palestinian survivors in Gaza continue to suffer, living under dire conditions in an ever-shrinking area.

Israeli violations of the ceasefire, effective since October 10, 2025, have resulted in the deaths of over 1,300 Palestinians and injuries to more than 4,330 others. Rescue teams have recovered numerous bodies from the rubble.

South Africa reiterated its commitment to pressuring Israel to comply fully and immediately with the ICJ's orders. The provisional measures aim to protect Palestinian rights as outlined in the Genocide Convention and prevent further harm to those rights before the court delivers its final judgment. South Africa first brought its case against Israel to the ICJ on December 29, 2023, alleging violations of the 1948 UN Convention on the Prevention and Punishment of the Crime of Genocide.

The court subsequently issued three provisional-measures orders in January, March, and May 2024, directing Israel to take necessary steps to prevent acts prohibited under the Genocide Convention.
