Judge: Pentagon punished Anthropic for ‘arrogance,’ and that’s illegal

A federal judge upheld Anthropic's claim that the Pentagon improperly labeled the AI company as a supply chain risk due to its criticism of the Department of Defense's stance on AI. Judge Rita Lin stated that the government's actions were motivated by a desire to punish Anthropic for its "arrogance" in criticizing the government, rather than any legitimate concern about the company's ability to engage in harmful activities.

The Pentagon had designated Anthropic as a supply chain risk in February after President Trump and Defense Secretary Pete Hegseth accused the company of endangering national security. This caused Anthropic CEO Dario Amodei to push back, expressing concerns about potential misuse of the AI technology for mass surveillance or autonomous weapons.

Lin ruled that neither the Constitution nor federal law allows the government to penalize Anthropic based solely on its critiques of policy. Anthropic had sued the Pentagon in March, alleging an "unlawful campaign of retaliation" over its unwillingness to permit unrestricted military use of its technology. The case highlights the contentious debate over how artificial intelligence should be regulated and employed in national security contexts.

Anthropic is also pursuing a separate legal challenge in the federal appeals court in Washington, D.C. over the Pentagon's supply chain risk designation.
