‘I have no problem with Public Tribunals Act’ – Supreme Court nominee Forson

Anthony Forson Jnr, the nominee for the Supreme Court, has expressed support for the recently enacted Public Tribunals Act. The law, passed by Parliament, does not raise any concerns for him, as long as it was enacted according to the provisions outlined in the 1992 Constitution, said Forson during his appearance before Parliament’s Appointments Committee on Thursday, August 27.

Speaking about the constitutional basis for public tribunals and the recently passed legislation, Forson emphasized the supremacy of the 1992 Constitution as the highest law in the land. He stressed that any legislation Parliament passes must align with the country’s fundamental law. "I have no problem with the Public Tribunals law," he stated, noting that Article 12 of the Constitution mandates that the Constitution is the supreme law, and if the fundamental law provides for it, he has no issue with it.

Forson further clarified that the legislation does not introduce any foreign concepts not already part of the Constitution, asserting that his concern would only arise if Parliament did not adhere to the constitutional requirements. "It is not something that is being imported into the Constitution," he affirmed, expressing confidence that the issue would only arise if Parliament deviated from the constitutional process.
