I see nothing wrong with the establishment of Tribunals - Supreme Court Justice nominee

Supreme Court nominee Anthony Forson Jr. has voiced opposition to capping the number of justices at the apex court, contending that its broad jurisdiction and workload make a fixed limit impractical. During a hearing before Parliament's Appointments Committee on August 27, 2026, Mr Forson explained that his stance on this matter was shaped by his experience and participation in talks on judicial reforms.

"I'm an advocate of no capping due to my experience and the seminars I've attended," he stated. He noted a previous parliamentary discussion where Justice Frimpong Manso expressed concerns about limiting the Supreme Court's membership, given the court's extensive jurisdiction. "In fact, Lord Justice Frimpong highlighted this issue in the chamber when we were conducting the constitutional review," Mr Forson recalled.

He argued that any decision to cap the number of justices should be evaluated in the context of the court's constitutional duties. "Unless Ghana decides to reduce the jurisdictions assigned to the Supreme Court, there should be no cap for now," he said. His remarks follow Ghana's consideration of constitutional reforms, including a government-backed proposal to cap the Supreme Court membership at 19 and institute a fixed term for the Chief Justice.

Mr Forson also pointed to the excessive workload that drove previous expansions of the Supreme Court, emphasizing that the same concerns remain pertinent. "A review of the arguments supporting the increase in the Supreme Court's membership shows that the existing composition could not handle the workload," he noted. "Hence, I contend that a cap is not warranted at this juncture."
