France's constitutional authority approves assisted-dying law

On Friday, France's top constitutional authority confirmed the full validity of legislation permitting adults with incurable conditions to seek assisted dying. The ruling by the Constitutional Council will see France align with the Netherlands, Belgium, Switzerland, and Canada in legalizing this practice. The law, enacted by the French parliament in July following extensive debate, establishes the right to assisted dying for certain adults suffering from terminal illnesses.

This victory marks a significant step for President Emmanuel Macron, who pledged to enact such legislation during his re-election campaign in 2022.

Eligibility for assisted dying requires patients to be of legal age, French nationals or long-term residents, and suffering from unbearable pain that is either unresponsive to treatment or not desired. A physician must verify the patient's eligibility, followed by an assessment by a panel to determine compliance with the criteria.

The physician ultimately makes the decision, and the patient can withdraw consent at any time. Administration of the lethal substance is self-directed, with exceptions for those physically unable to do so and who can receive assistance from a healthcare worker.

Despite the constitutional authority's full approval, it noted that certain provisions required further clarification. Specifically, the so-called conscience clause, which allows healthcare professionals to refuse participation in the procedure, needs further definition. The clause must also extend to private healthcare facilities where assisted dying conflicts with the establishment's mission, as long as it is not the sole option available to meet local needs, according to the council's decision.
