France’s constitutional authority approves assisted-dying law

The Constitutional Council of France has officially validated comprehensive legislation allowing adults with terminal illnesses to opt for assisted dying, while indicating that certain aspects require further clarification. This decision places France alongside countries such as the Netherlands, Belgium, Switzerland, and Canada that have previously legalized this practice.

The law, which was adopted by the French parliament in July following extensive deliberation, grants the right to assisted dying to some adults suffering from an incurable condition. Eligibility for this option is strictly governed; patients must be of legal age, French nationals, or long-term residents, and must experience pain that is either untreated or deemed unmanageable despite treatment efforts.

Physicians are tasked with determining eligibility, and a panel ultimately assesses whether the criteria are met before the physician makes the final decision. Patients have the autonomy to withdraw their consent at any stage. Administering the lethal substance is a self-directed process, with exceptions made for those who lack the physical capability to do so and require assistance from healthcare workers.

Despite the overall approval, the council flagged the necessity for amendment in certain provisions, notably the concept of conscientious objection, which permits healthcare professionals to decline participation in the procedure. Additionally, this clause must also extend to private healthcare providers who could argue that offering assisted dying is fundamentally against their mission, on the condition that they are not the sole providers able to cater to the local demand, according to the constitutional body.
