Commercial misuse of court remarks: Supreme Court seeks Government reply on plea for CBI probe

The Supreme Court has requested the Government to respond to a plea for a Central Bureau of Investigation (CBI) probe into the commercial misuse of its court remarks. Specifically, the court is concerned about how interactions in the courtroom, including recent "metaphorical expressions" about cockroaches, are being "meme-ified, mimicked, commercially circulated, and transformed into viral digital content detached from constitutional and procedural context". This is undermining the constitutional promise of justice.

Led by Chief Justice of India Surya Kant, the bench comprising Justice Joymalya Bagchi and Justice V Mohana sought responses from the Centre, the CBI and the Bar Council of India. The plea also urged the court to investigate allegations related to fake advocates, fraudulent law degrees, impersonation within the legal practice, and the deterioration of professional standards in the legal profession.

The petitioner, advocate Raja Choudhary, referred to the court's proceedings on May 15, 2021, where the Chief Justice made the "cockroaches" remark. He clarified that the comment was in the context of "fake law degrees" and institutional frustration, not a broader condemnation. Choudhary argued that the metaphorical expressions involving animals, insects, and vermin have historically been used in literature, jurisprudence, and legal discourse to express institutional anxiety and procedural disorder, not as literal critiques.

The plea invoked Franz Kafka's "The Metamorphosis" to argue that vermin imagery is a recognized tool for symbolic commentary on social behavior and institutional issues. It contended that similar expressions, such as "Jungle Raj" and "fraud on the Constitution", have always been understood within their constitutional and legal context rather than through a literal interpretation.

The petitioner noted that the commercialization of these judicial controversies, including activities associated with the "Cockroach Janta Party" and its alleged trademark-commercial assertions, demonstrates organized commercial appropriation of judicial proceedings.
