Court rejects 30-day detention for two suspects in Dr Mutiso murder case

On September 30, a Nairobi court rejected an application by the Office of the Director of Public Prosecutions (ODPP) to detain two suspects for 30 days in connection with the murder of Dr Victoria Mutiso. The suspects, Police Constable Collins Bett and Pius Muiru Mbugua, also known as "Headboy," face murder charges under Section 203 and 204 of the Penal Code.

The prosecution alleges that the two, along with unnamed accomplices, murdered Dr Mutiso on July 29, 2026, near Mawensi Road in Kilimani Sub-County, Nairobi County. The ODPP sought to detain the suspects for 30 days to allow for further investigations and mental assessments. However, the court, presided over by Justice Alexander Muteti, found the 30-day detention period unreasonable and directed the ODPP to allow until October 5 for the mental assessment.

The judge also emphasized the importance of equality and avoiding complaints by not extending the detention period. The case will be revisited after the completion of the mental assessment, with plea-taking expected to be addressed alongside the related matter.
