SC seeks EC time frame for decision on TMC name, symbol dispute

The Supreme Court of India recently intervened in the ongoing dispute between two factions of the All India Trinamool Congress (TMC) over the party's name and symbol. The bench, comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana, expressed the need for a timely resolution to the issue, emphasizing that delays could have detrimental consequences.

The bench highlighted the detrimental impact of the delay in the Shiv Sena factional dispute case. Appearing for Mamata Banerjee, the petitioning party, advocate Kapil Sibal stated that he was not seeking a stay on the interim order imposed by the Election Commission (EC) since bypolls had commenced. However, Sibal questioned the EC's decision to issue the interim order during the election period, arguing that it left his client without a remedy and sought a final order by the end of October.

The rival faction, represented by senior advocates Mukul Rohatgi and N K Kaul, requested more time to adjudicate the dispute, arguing that a one-month period was insufficient as the process would require submission of affidavits and evidence. The court instructed EC's counsel, Dama Seshadri Naidu, to determine the appropriate timeframe to decide the matter, ensuring a fair opportunity for both parties and allowing the court to apply its mind. The bench subsequently posted the case for a final decision on September 28.
