1MDB is seeking a ruling from the Federal Court to withdraw its lawsuit against UK-based law firm White & Case over a $1.83 billion fraud and conspiracy claim involving PetroSaudi International Ltd. The hearing for the court's permission to proceed with the lawsuit was set for October 12, according to a statement from 1MDB's legal counsel, Lim Zhi Ying.

1MDB has raised 26 legal issues related to jurisdiction and consolidation of its lawsuit against White & Case, in an attempt to secure a fair ruling from the highest court in Malaysia. On August 12, the Court of Appeal allowed White & Case's appeal and dismissed the lawsuit filed against them. At the three-judge panel, Judge K Muniandy noted that the requirements under the Courts of Justice Act 1964 and the Court Procedures Act 2012 for filing court documents outside Malaysia were not met. Panel members included Judge Alwi Abdul Wahab and Judge Aliza Sulaiman.

Muniandy also found that the $1.83 billion lawsuit against 1MDB in 2024 was filed outside the time frame set under the Limitation of Actions Act 1953, taking into account the claim of loss and fraud involving the implicated assets had already become public knowledge in 2015 and 2016. Under the act, plaintiffs are generally required to initiate proceedings within six years from the date of the causal act.

The Court of Appeal also dismissed the order of the High Court that allowed 1MDB to consolidate its lawsuit against White & Case with a separate action against Deutsche Bank involving $1.11 billion. Muniandy deemed the consolidation request as a tactical move by 1MDB to overcome jurisdictional issues.
