Peguam dakwa kerajaan N Sembilan buat ‘rampasan kuasa’, ancam tindakan hina mahkamah

Peguam Tuanku Muhriz Tuanku Munawir has accused the government of Negeri Sembilan of exercising excessive power by declaring the removal of Tuanku Muhriz's position as Yang Dipertuan Besar and acknowledging Tuanku Nadzaruddin Tuanku Ja’afar as the new cabinet. In a letter to relevant parties, the lawyers of Halim & Ismail expressed their surprise at the announcement made by the exco and emphasized that the body in question has no authority, power, or jurisdiction to make such declarations.

They characterize the announcement as illegal, invalid, and having no legal effect. The lawyers further claim that the action aims to challenge the executive power of Tuanku Muhriz and ultimately undermine the throne. They also allege that such conduct constitutes a violation of excessive force and other illegal acts, which can be punished under the Law of Assault and other legislations.

Moreover, the lawyers assert that the announcement contravenes the interim injunction issued by the High Court on June 5. They state that the injunction was granted due to the court's recognition on July 8 to commence contempt proceedings. The lawyers plan to initiate contempt proceedings against the officials for violating the interim injunction as stated above.

The letter was issued a day after the exco declared the dissolution of Tuanku Muhriz's position as valid and Tuanku Nadzaruddin as the new Yang Dipertuan Besar with immediate effect. The exco claimed that the proclamation issued on April 19, for removing Tuanku Muhriz's position, was signed and sealed by Undang Yang Empat, which is valid.

It also mentioned that the proclamation was signed by Ismail on August 3, completing the process in accordance with Perak Section 10(2). The lawyers also question whether Ismail endorsed the exco's recent statement, while stating that it was only signed on behalf of the exco members of Negeri Sembilan.
