Mumbai 26/11 Terror Attack Case: Court Defers Plea For In-Absentia Trial Of 6 Absconding Accused Until September 30

Mumbai, September 17, 2026 - The plea to commence trial against the six accused who have fled the scene in connection with the 26/11 terror attack is being postponed. Prosecutors have requested additional time to deliver a proclamation order to the suspects, currently held at the Ministry of Home Affairs. The proclamation notice was obtained in June for Hafeez Saeed, Zaki ur Rehman, Sajid Mir, Major Pasha, Abu Alqama, and Asim (alias Abu Qahafa) to proceed with their trial in absentia if they do not show up.

The Mumbai police have also requested Interpol to deliver a copy of the proclamation order to the suspects in Pakistan, where they are believed to be residing. On Thursday, the prosecution submitted a report to the court, stating that they are still waiting for a response from the Ministry of Home Affairs. Consequently, the court has granted them an extension until September 30, and the hearing on the prosecution's plea has been postponed.

Under the new criminal law, the prosecution can initiate the trial against the absconding accused if they fail to appear even after being declared proclaimed offenders. Following procedural compliance, the court may order a trial against the accused in their absence, and a lawyer from the legal aid cell may be appointed to represent them.
