CPI seeks release of ‘political prisoners’ languishing in jails for years

The Communist Party of India (CPI) Andhra Pradesh has called for Chief Minister N. Chandrababu Naidu to order a review of cases involving individuals detained for extended periods in Indian jails on charges stemming from political and public movements. In a letter addressed to the Chief Minister, CPI Andhra Pradesh secretary G. Eswaraiah urged steps to release those eligible under law.

Eswaraiah highlighted that numerous individuals arrested while campaigning on political, social, and public issues have languished in prison for years. While the Constitution does not recognize a distinct legal status known as "political prisoner," the government should consider such cases in the spirit of justice, human rights, and constitutional values, Eswaraiah argued. Detainees facing cases include Dalits, Adivasis, members of people's organizations, democratic activists, and social activists.

The CPI leader expressed concerns about the difficulties in securing bail under stringent laws, such as the Unlawful Activities (Prevention) Act, which could lead to prolonged pre-trial detention when trials are delayed. Eswaraiah advocated for special consideration of cases involving elderly individuals, those suffering from illnesses, women, and prisoners who have faced trials for extended periods. He urged the government to identify cases with avoidable delays and expedite proceedings.

Additionally, Eswaraiah requested free legal aid for those in need and special humanitarian treatment in appropriate cases. He also emphasized the importance of ensuring prisoners have effective access to family members, medical facilities, lawyers, and legal aid. The CPI leader requested the Chief Minister to intervene and take measures for the release of eligible long-term prisoners, sending copies of the representation to Home Minister V. Anitha and Director-General of Police Harish Kumar Gupta.
