"In principle, an employer cannot force an employee to use their private car," explains Volker Görzel, an attorney specializing in labor law.

After all, the employer is obliged to provide all necessary means of transport for the job. If a car is required for the work, it must be made available. When it comes to using a private vehicle for work purposes, the employer can still ask. Employees can then decide whether to use their own car or not. However, if the use is already stipulated in the employment contract, then it must be followed.

Employees who sign contracts with such conditions or who offer to use their cars should pay attention to all financial aspects of the trips upfront. They should discuss which expenses and mileage reimbursements the employer will cover, as well as who is liable in case of an accident, according to Görzel.
