Verkehrsrecht: Beim Abbiegen überholendes Auto gerammt - Alleinschuld

In a rural road incident, a driver passed two vehicles before a car in front of the overtaken one signaled a left turn into a forest road. The overtaking driver was unable to brake in time and drifted into the passing vehicle. According to a judgment (case number: 8 O 164/25) from the Landgericht Potsdam, the overtaking driver bears sole responsibility for the accident.

The ADAC emphasized this decision. The court found no signs of the overtaking driver planning to turn onto the forest road. They also could not prove whether the driver had signaled early enough, reduced speed, or moved the vehicle slightly toward the center of the road. This absence of signs of a turn was the main reason the court ruled the overtaking driver not at fault.

Another issue was the damage to the overtaking car's right door, suggesting the vehicle had already been at the same height, indicating the driver likely did not check the rearview mirror before turning. The law requires drivers to check both oncoming traffic and traffic behind them when making a left turn, known as the "double rearview mirror duty." The court stressed that one should check the rearview mirror before and after turning.
