Israel violated ICJ provisional measures, South Africa says in new dossier

South Africa has filed a new dossier with the International Court of Justice (ICJ) alleging that Israel has violated the court's provisional measures pertaining to the Gaza conflict. The Department of International Relations and Cooperation released a statement on 25 August, outlining the information contained in the dossier and its intended purpose. The dossier aims to assist an ICJ committee in monitoring Israel's adherence to the provisional orders and exploring potential options for the court.

According to the South African department, Palestinians continue to suffer from a lack of access to vital resources such as water, healthcare, medicine, and other essentials. The department emphasized that South Africa will persist in pursuing "all avenues available" to compel Israel to fully and immediately comply with the court's directives.

Furthermore, South Africa accused Israel of the unlawful killing of local journalists and the prohibition of foreign journalists and UN-mandated investigative bodies from entering Gaza. Since the announcement of the "ceasefire", on average, one Palestinian child has been killed daily by the Israeli military. The statement also highlighted a disturbing increase in Palestinian miscarriage rates in Gaza, which have more than tripled in 2026.

The ICJ issued provisional measures in 2024, requiring Israel to take all feasible measures to prevent genocidal acts as outlined in Article 2 of the 1948 Genocide Convention.
