Afenyo- Markin: Sammy Gyamfi has been duly served with my writ

Solicitor for plaintiff Osahen Alexander Afenyo-Markin has dismissed allegations that his client is evading the service of a writ in a defamation lawsuit against Ghana Gold Board's CEO, Samuel Adu Gyamfi. According to a statement on behalf of Mr. Afenyo-Markin, the writ, filed at the High Court on August 24, 2026, was served on a law firm that had obtained authority to accept the service on Gyamfi's behalf.

The statement revealed that a bailiff delivered the writ to the law firm on August 26, 2026, after obtaining the "express instructions and authority" from Mr. Gyamfi. However, the law firm returned the writ the next day, August 27, citing that their client had changed his mind about accepting service through them.

When the bailiff attempted direct service on Gyamfi at his office, he refused to accept the writ and ordered his security to expel the bailiff from the premises. The solicitor rebuffed claims on social media that Afenyo-Markin was avoiding the service, stating that it is the court registry's responsibility under Ghanaian civil procedure to deliver a writ to a defendant after it's issued upon the plaintiff's application.

The solicitor pointed to Order 7, Rule 12(2) of the High Court (Civil Procedure) Rules, 2004, which validates service where a writ is given to a lawyer who has agreed in writing to accept it on behalf of the client. The statement urged those spreading false claims to cease, asserting that the relevant correspondence and bailiff's official record would verify the events.
