Peniaga dipenjara 10 tahun rempuh 3 individu di bazar Ramadan

A vendor was sentenced to 10 years in prison for attempting to kill three individuals after ramming their tricycle at a Ramadan bazaar in Bukit Sentosa, Hulu Selangor in May 2020. The Kuala Kubu Baharu Sessions Court handed down the sentence to Kang Ming Han after finding him guilty on three counts of attempted murder under Section 307 of the Penal Code.

The judge also fined him RM15,000 or 18 months in jail if he fails to pay the fine. Kang was also found guilty of causing injuries to Farina Hazlin Shaiful Azmi and Yusanisah Jais through drunk driving under Section 44(1) of the Road Transport Act. He faces seven years in prison and a total fine of RM20,000 or an additional year in jail if he fails to pay the fine for each charge.

Kang also received a RM500 fine for using abusive language towards police officer Shahidan Abdul Khalil. The judge ordered all sentences to be served concurrently, meaning Kang will only serve a 10-year prison term. According to the facts, Kang was involved in a dispute with several individuals in the market area after honking his horn while dealing with traffic congestion.

In his explanation, Kang claimed that unknown individuals and passengers attacked him and his passengers by breaking his car's side mirror. He then went to Bukit Sentosa Police Station, but the officer on duty claimed Kang acted aggressively and refused to cooperate. The officer told the court that Kang left the station without filing a formal report of the alleged assault and asked to "ram all the people in Bukit Sentosa because you refuse to accept my report."

The court then heard from Norisham, Baharum, and Mahadin about how they were rammed by Kang's tricycle at the bazaar. All three sustained injuries to their body parts, including the arms and legs. Kang's tricycle also collided with Farina's four-wheeler vehicle, causing her and Yusanisah, who were passengers, to suffer injuries.

The incident ended when Kang ran back to the police station after being chased by a group of people before being arrested. In his defense, Kang claimed the initial police officer refused to accept his report of the alleged assault and denied making an admission. He also denied uttering abusive language and claimed he returned to the market area to "see if the attacker from before was still there" before being attacked again by "several people."

Kang denied ramming the three men and claimed he was merely "dazzled" by Farina's car in an accidental manner. The judge stated that Kang failed to raise reasonable doubt for all charges and referred to his intention to cause injury. "He cannot use self-defense as an excuse when he returned to the market a second time to find the alleged attacker," she said.
