‘No Supreme Court seat is vacant’ — Afenyo-Markin objects to rushed Supreme Court nominees’ vetting

Minority Leader Alexander Afenyo-Markin has questioned the haste in vetting three Supreme Court nominees, arguing there is no vacant seat on Ghana's apex court. He raised concerns during a parliamentary session on August 27, 2026, when the Appointments Committee began the vetting process. Afenyo-Markin emphasized that his objection was to the speed of the procedure, not the nominees themselves or the President's authority to appoint justices.

The Minority Leader presented nine grounds for his objection, including the absence of a vacancy and the need for a regular notice period for Supreme Court nominations since the 1992 Constitution. He challenged the Majority to prove the harm caused by delaying appointments, stating that no such harm could be demonstrated. The Minority Leader also criticized the compressed parliamentary timetable, questioning why only three days were allocated for consideration after the President's nominations were announced.

Afenyo-Markin clarified that his position was not against the nominees or the President's constitutional authority, but rather about the procedural concerns and the justification for accelerating the process.
