Legal vacation: Oppong Nkrumah files for reversal of injunction application ruling

Kojo Oppong Nkrumah, Member of Parliament for Ofoase Ayirebi, has submitted a petition to the Supreme Court to overturn the decision that dismissed his application to stop the conduct of criminal trials by certain High Court judges during the legal vacation. The Supreme Court previously denied the interlocutory injunction application, which was filed by Oppong Nkrumah, on August 21, 2026.

The Member of Parliament invoked the original jurisdiction of the Supreme Court, challenging the Chief Justice Paul Baffoe-Bonnie's decision to allow selected judges to hear criminal cases during the vacation. His claim questions the constitutionality of the arrangement, raising concerns about equality before the law and the proper exercise of administrative discretion.

Oppong Nkrumah argued that the selective application of laws was a significant issue and that his party, the New Patriotic Party, would continue to address this problem through any available means. Following the dismissal of his injunction application, Oppong Nkrumah posted on his social media platform, stating that the Supreme Court dismissed his request to halt criminal trials during the legal vacation.

Justice Pwamang ruled that while the expedited treatment of some cases does not infringe upon the rights to equality before the law and a fair trial. He noted that the warrants issued by the Chief Justice are aimed at ensuring the expeditious handling of criminal cases such as galamsey and narcotics. The Chief Justice's decision to issue warrants to selected High Court judges during the legal vacation was intended to allow for a more efficient handling of criminal cases.
