Oppong Nkrumah heads back to Supreme Court over legal vacation ruling

Ghanaian Member of Parliament Kojo Oppong Nkrumah is appealing a recent Supreme Court ruling that dismissed his attempt to halt criminal trials conducted by selected High Court judges during the country's legal vacation. Earlier this month, Mr. Nkrumah sought an interlocutory injunction to suspend the operation of administrative warrants issued by Chief Justice Paul Baffoe-Bonnie, authorizing these judges to handle criminal cases during the vacation period from August 1 to September 30.

However, Justice Gabriel Scott Pwamang ruled against his application, stating that he had not provided sufficient grounds for the interim relief. The Supreme Court also dismissed concerns about the arrangement being discriminatory, as the warrants permitted the affected judges to proceed with pending cases. Nonetheless, Mr. Nkrumah's core argument remains intact, as his substantive constitutional challenge to the Chief Justice's administrative actions continues to be considered by the Court.

Oppong Nkrumah's legal team argues that the continuation of criminal trials during the vacation period could undermine defendants' rights to fair representation, particularly in cases where legal counsel may be unavailable during this time. The legal dispute has sparked public discourse on the objectives of the annual legal vacation and the extent to which the Judiciary can employ such measures to expedite the handling of criminal cases.
