Oppong Nkrumah seeks Supreme Court review over legal vacation ruling

Kojo Oppong Nkrumah, a Member of Parliament from Ofoase-Ayirebi, is requesting a review from the Supreme Court regarding the decision made by Justice Gabriel Scott Pwamang. The decision dismisses Nkrumah's request to stop criminal trials being handled by certain High Court judges during the legal vacation period, which is scheduled from August 1 to September 30.

This marks a significant step in Nkrumah's ongoing legal battle against Chief Justice Paul Baffoe-Bonnie's administrative warrants that allow these judges to conduct criminal proceedings during the vacation. Initially, Nkrumah approached the Supreme Court, arguing that the arrangement raises constitutional issues such as equality before the law and the appropriate use of administrative powers.

He subsequently sought an interlocutory injunction to halt the operation of the warrants while the Supreme Court decided on the broader constitutional challenge. However, Justice Pwamang rejected Nkrumah's application, stating that he had not presented a compelling enough case to warrant the interim relief. The court also dismissed concerns of discrimination, asserting that the warrants enable the affected judges to manage cases currently pending before their respective courts.

Consequently, the Supreme Court ruled that criminal trials can proceed during the legal vacation period. Despite the injunction application being dismissed, Nkrumah's core constitutional challenge to the Chief Justice's warrants has not been resolved. This case underscores the ongoing debate about the balance between expediting criminal justice and ensuring fair legal proceedings.
