The Indore bench of the Madhya Pradesh High Court has ordered that two minor children be returned to their mother after she was evicted from their home for refusing to compromise in a sexual assault case involving her elder daughter. The decision was made by a division bench consisting of Justice Subodh Abhyankar and Justice Alok Awasthi, who issued the order while considering a habeas corpus petition submitted by the woman, identified as Kavita.

According to Kavita, her five-year-old daughter is the victim of a serious sexual offense, and criminal proceedings are currently ongoing against the accused. Despite facing pressure from her husband to settle with the accused, Kavita persisted in seeking justice for her daughter. Her husband allegedly forced her out of their marital home and took custody of their two children, aged five and three.

Initially, Kavita approached the Child Welfare Committee, which placed the children in protective custody at Jeevan Jyoti Ashram shelter home. She subsequently filed a petition in the High Court, requesting custody of her children. During a previous hearing on August 14, the court directed that the children be brought before the court and issued notice to the husband.

However, when the matter was heard again on Tuesday, both children were present before the bench. The court noticed that, despite being made aware of the proceedings, the husband did not attend. Considering the facts and the husband's absence, the High Court has now directed that the children be handed over to their mother immediately.
