HLHS is a serious condition where the left side of the heart is underdeveloped, requiring surgery shortly after birth and potentially more procedures as the child grows. The couple initially sought to terminate the pregnancy, but West allegedly changed her mind. The disagreement escalated, leading to legal disputes involving multiple states over parental rights, surrogacy agreement, and medical decisions.

Texas intervened due to its laws regarding abortion and the legal status of children, with Texas Attorney General Ken Paxton seeking protection for the baby and arguing for life-sustaining treatment. A Texas judge ordered medically indicated stabilizing and life-sustaining care for the infant and restricted the baby's removal from Texas while legal proceedings continued.

West's attorney is challenging this arrangement, arguing for her to be recognized as the child's legal mother under Texas law.
