Karachi's Red Line suffers another blow as decision to cancel Mosamiyat-to-Numaish contract declared ‘invalid’

Karachi's Red Line project has been dealt another severe setback as the Sindh government's decision to cancel the BRT Red Line construction contract has been declared invalid by the Dispute Resolution Board. This ruling, delivered after a high court directed both parties to approach the board, not only throws a major wrench into hopes of resolving Karachi's transportation crisis but also exposes critical shortcomings of the project's implementing agency, TransKarachi.

The Dispute Board's decision comes after TransKarachi's contractor, AM Associate, challenged the government's termination of Lot-2, the key segment of the Red Line project from Mosamiyat to Numaish, claiming the decision was premature and lacked proper consideration of contractual alternatives. The board's verdict highlights the agency's institutional limitations, citing a lack of experienced project management, inability to finalize the design, and numerous outstanding payments to the contractor.

Furthermore, the board found that the government-owned company failed to meet several fundamental contractual obligations, including providing the site free of encumbrances and resolving outstanding disputes. These failures, combined with the project's scale and complexity, have significantly impacted TransKarachi's ability to execute the works effectively.

The board emphasized that effective contract management could have potentially preserved the agreement, concluding that the termination was premature and not a last resort measure.
