Breaking: Trump moves to ban 'birth tourism' and restrict birthright citizenship

US President Donald Trump has signed two executive orders aimed at restricting birthright citizenship in the United States, following the Supreme Court's June ruling that his previous attempts were unconstitutional. These orders broaden the government's definition of those ineligible for birthright citizenship and instruct immigration officials not to grant visas to non-citizens suspected of entering the country solely to give birth on US soil. Both orders are anticipated to face legal challenges.

The White House claims these new directives do not fall under the Supreme Court's ruling, enabling them to expand the group deemed ineligible for birthright citizenship, including those arriving for "birth tourism" purposes. The order explicitly bans birth tourism, stating that no individual shall be permitted a visa for this fraudulent objective. Deputy Chief of Staff Stephen Miller announced at the signing ceremony that no one worldwide will henceforth be permitted a visa for this deceptive purpose.

The executive orders also curtail the rights of children born to foreign government employees in the US, as well as children of individuals classified as "alien enemies." They may also impact individuals born in US territories, should Congress pass a proposed law abolishing automatic citizenship there. Each order and subsequent legislation is expected to face further court challenges.

Trump lamented the Supreme Court's June decision, deeming it "unfortunate" and "disgraceful," explaining that it "was close, but a very, very unfortunate decision." He added that the practice of birth tourism has fostered business opportunities, which must be halted as it is "not the way it's supposed to work."

The 14th Amendment, which has traditionally guaranteed citizenship to all individuals born in the United States, barring narrow exceptions like foreign diplomats' children or those in enemy forces, is the constitutional provision under scrutiny. The new orders represent a shift in policy, distinct from Trump's initial executive order from January 2025, which barred children of non-citizen or non-permanent resident parents from being recognized as US citizens unless born to illegal or temporary residents.

The Citizenship Clause of the 14th Amendment stipulates that all persons born or naturalized in the US, subject to its jurisdiction, are citizens of the US and the state where they reside.
