Pengasuh, pengusaha taska diarah bayar ganti rugi RM65,000 berkait kes Baby Syifaa

The High Court in Seremban has mandated a caregiver and owner of a childcare center, Khairunnisa Ahmad Damanhuri and her sister Nadzirah, to pay RM65,000 in compensation to the family of a deceased infant known as Baby Syifaa. The court found the caregiver and the center owner responsible for contributing factors leading to the infant's death.

The infant, Nour Rania Asyifaa Yuseri, tragically passed away on February 22, 2022, while under the care of the center located in Bandar Seri Sendayan. Nour Rania was a one-year-old at the time. Her mother, Anida Idrus, filed a lawsuit against Khairunnisa and Nadzirah in 2025, alleging neglect for placing Nour Rania in a garment and leaving her unattended.

During the trial, the court was informed that Khairunnisa left Nour Rania unattended to perform morning prayers and have lunch. Judge Roz Mawar Rozain allowed Anida's claim against the caregiver and center owner, ruling that the mother successfully proved her case based on the balance of probabilities. He determined that Khairunnisa failed to provide the minimum level of care expected of a caregiver or caregiver.

"A reasonable caregiver would arrange for another caregiver to step in for a period or visually check on the infant frequently. Neither of these essential care-taking steps was taken. The effort to perform either of these actions was not costly, yet the possibility of the infant becoming entangled in the garment could result in serious consequences," said Roz Mawar.

Regarding Nadzirah, the court ruled that she did not check on Nour Rania throughout Khairunnisa's absence and did not request anyone else to do so. "A childcare center must be managed with a system that allows the caregiver to fulfill personal needs without leaving the infant unattended. The absence of anyone to assume responsibilities for a short while indicates weak management, not an unavoidable circumstance," said Roz Mawar.

At the beginning of this year, in separate proceedings, Khairunnisa was sentenced to one year in prison and fined RM15,000 for her negligence leading to Nour Rania's death.
