A-G challenges Court of Appeal’s ruling in ex-Buffer Stock CEO case at Supreme Court

The Attorney-General of Ghana has lodged an appeal at the Supreme Court to overturn the Court of Appeal's recent decision to suspend the trial of Hanan Abdul-Wahab Aludiba, the former CEO of the National Food and Buffer Stock Company. In October 19, a three-judge panel of the Court of Appeal, led by Justice Noble Nkrumah, decided to halt the trial pending their review of an appeal concerning the charge sheet.

The court believed that the charge sheet was the cornerstone of the trial and that a challenge to it must be addressed.

Justice Nkrumah's panel deemed the issues raised by Mr Aludiba as exceptional and believed they warranted a stay of proceedings. However, the Attorney-General argues that the Court of Appeal misinterpreted the law when it held that merely challenging a charge sheet should be considered an exceptional ground for suspending a criminal trial.

He contends that such a ruling could severely impede the functioning of criminal trials, as any accused person could simply raise any challenge against the charge sheet and demand a stay until their claim is resolved.
