Supreme Court ruling lifts limits on foreign land ownership

Argentina's Supreme Court has lifted the limits on foreign land ownership, overturning a lower-court ruling that had blocked a provision in President Javier Milei's 2023 mega decree. The Land Law, passed in 2011, previously imposed restrictions on how much rural land foreigners could own, setting a cap of 15% nationally, provincially, and municipally.

Additionally, the law limited single foreign ownership to 1,000 hectares in the country's agricultural core region. The Supreme Court's decision does not directly declare the decree repealing the law constitutional, but the practical effect is that the foreign ownership limits have been lifted. The three-member court panel ruled in favor of the Center for Malvinas War Veterans, stating that the group did not have legal standing to bring the case and that there was no qualifying collective legal dispute before the court.

As a result, foreign individuals, companies, and foreign states can now purchase rural land in Argentina without the previously imposed caps.
