Lindsay Clancy back in court as lawyers seek to have murder case dismissed

Lindsay Clancy will return to Plymouth Superior Court on Tuesday for her first hearing since a mistrial in her high-profile murder case on September 4th. The court hearing is set to commence at 9 a.m. Prosecutors have filed a motion to impose a gag order to prevent prejudicial extrajudicial statements to the media. If granted, the order would prohibit lawyers from making statements to the press that could potentially influence the outcome of the trial.

The defense argues that defense attorney Kevin Reddington regularly provided updates to the media, criticized witnesses, praised Clancy, and spoke negatively about the jurors. Specifically, Reddington referred to the holdout juror as "he" during a news conference, which could have easily identified the juror among the three male jurors.

Despite the jury's verdict being sealed, some jurors have spoken out, with one anonymous juror expressing doubt and another juror Paula Devlin confirming the jury's split 11 to 1 in favor of not finding Clancy guilty of criminal responsibility. During recent interviews, defense attorney Kevin Reddington was questioned about the possibility of a plea deal.

He stated that a plea deal was not feasible during the first trial due to the murder charge and that it ultimately depends on the decision of Plymouth District Attorney Tim Cruz. Reddington affirmed his commitment not to agree to any plea deal that would result in Clancy serving any jail time, emphasizing his unwavering opposition to her incarceration.
