Judge holds decision on Saskatoon encampment injunction

A Saskatoon judge will consider whether to halt the city's dismantling of a west-end encampment, with a decision expected within days. Attorneys from the city and encampment residents presented arguments in Court of King’s Bench on Monday. Crystal Fafard, representing the encampment dwellers, seeks an injunction to prevent the city's removal of residents without adequate shelter options.

She highlighted constitutional and human rights concerns about moving residents without appropriate housing and suggested temporary solutions such as sanitation assistance. The city responded by deeming protestors "aggressive" for blocking contractors and climbing fences, which slowed the dismantling process. Fafard, identified as an Indigenous advocate, argued against the forceful removal, fearing it would push people into other city areas.

The city contends it observed a spike in encampment structures around 20th Street, with complaints from residents, businesses, and an elementary school. Concerns were raised about public health issues, including human waste and rotting food attracting insects and rodents. The province’s attorney general is also involved due to constitutional matters.

Fafard's application, though filed with public policy issues, lacked the usual evidence and civil court experience. David Fineday, a resident in the encampment, expressed emotional distress over the proceedings, asserting his belief that city officials should treat homeless individuals with more respect. The city has stated it will not take further action against the encampments until a court decision or an emergency situation arises.
