Govt looking to expand Child Act provisions on predation, grooming

The Malaysian women, family and community development ministry is examining potential expansions to the Child Act 2001, aiming to address sexual misconduct involving minors, including issues of predation and grooming between peers, according to Minister Nancy Shukri. Recent cases, including that of a 13-year-old arrested for child sexual abuse material, have prompted this review.

Shukri emphasized the importance of careful consideration to prevent any unintended legal consequences, such as double jeopardy, where individuals could face prosecution twice for the same offense. The ministry is committed to refining any proposed provisions thoroughly. The legal age of a child in Malaysia is 18, but the ministry recognizes that certain actions transcend typical child behavior.

Shukri stated that the process of drafting the bill would be meticulous, involving a thorough review of current issues and input from various stakeholders to ensure a comprehensive Child Act. Previous reports indicated that children as young as 13 have been involved in creating sexually explicit animated content, a discovery stemming from a joint operation by the police and the Malaysian Communications and Multimedia Commission from September 14 to 16.

In July, Shukri announced that amendments to the Child Act 2001 were being reviewed, incorporating 159 recommendations from the United Nations Committee on the Rights of the Child.
