The Federal Court has overturned the decision to reduce prison sentences for two men who were convicted of drug trafficking, ordering them to serve the remaining 30-year prison terms and additional 12 strokes of the rotan cane. Azril Azhar Ahmad, 50, and Zulfattar Ridzuan, 44, were each sentenced to 30 years and 12 strokes of the rotan cane after being found guilty of trafficking 264.36 grams of ganja.

The three-judge panel, led by Justice Rhodzariah Bujang, found the prosecution had successfully proven their guilt without a shadow of a doubt. The court overturned the decision by the Court of Appeal from last May, when it had changed the charge from trafficking to possession due to the small amount of ganja exceeding the permitted limit.

Both men were arrested after police found 264.36 grams of ganja in a Grab car at Galla Industrial Park, Seremban, around 5:40 pm on September 26, 2020. The court also considered evidence of drug trafficking paraphernalia, including a digital scale, plastic bags, a small knife, and a syringe, found in the car where the ganja was discovered.

The judges noted that the appeal court erred when it found sufficient evidence of trafficking. The men were sentenced to serve their remaining terms from the date of their arrest on September 26, 2020. They were released from prison on February 23 after serving part of their reduced sentences. Both men were present in court when the Federal Court announced its decision.

However, Azril, who is now 50, will not serve any additional time due to Malaysia's law that exempts men over 50 from caning. Zulfattar, on the other hand, has 12 strokes of the rotan cane to serve. Azril was represented by Hasnan Hamzah and Qushwa Hasnan, while Zulfattar was represented by Jaspal Singh Mann and Pramjit Kaur. The Deputy Public Prosecutor, How Mei Ling, also appeared on behalf of the prosecution.
