To annul marriage, man claims wife hid ailment, Calcutta High court slaps fine

The Calcutta High Court has dismissed a man’s request to annul his marriage, citing that his wife and her family allegedly concealed her chronic medical condition before the wedding. The court ordered the man to pay Rs 1 lakh towards the cost of the legal proceedings. The court found that the man failed to provide any medical or expert evidence to demonstrate that his wife’s condition impacted the marriage or that she or her family actively concealed the condition.

The case originated from a December 2025 trial court order that rejected his annulment plea. According to the man, his wife had suffered from Idiopathic Thrombocytopenic Purpura, a blood disorder, since 2007, but he only discovered this after their marriage in March 2016. The wife argued that her father had sent her medical documents to the man’s father before the wedding, ensuring transparency.

The court noted that the husband did not examine his father as a witness and did not present any medical evidence to support his claims about the marriage's impact of his wife’s health. Consequently, the high court upheld the trial court’s decision and ruled that the husband must pay the fine.
