Land partition based on taluka surveyor report valid

In a recent ruling, the Karnataka High Court has upheld the 2009 partition of 14 disputed land parcels between the Reddy and Gowramma families based on the Taluka Surveyor's report. The court dismissed the Reddy family's argument that the Taluka Surveyor's lower rank compared to the Tahasildar made the partition legally flawed, as both the Tahasildar and Taluka Surveyor are Taluka-level officers responsible for different functions.

The court clarified that the Taluka Surveyor's role is to conduct the survey, not to adjudicate third-party encroachments. Therefore, the omission of encroached portions in the survey report does not invalidate the partition. Additionally, the court recognized the families' right to pursue legal action for compensation and land encroachment separately.
