Suspended Deputy National Commissioner Lieutenant-General Shadrack Sibiya faces significant legal challenges in his bid for bail, according to legal practitioner Zola Majavu. Sibiya appeared in Randburg Magistrate's Court, where he is charged with rape, human trafficking, and the sexual grooming of a 16-year-old girl. Sibiya is set to return to court on September 29 for a bail hearing.

Majavu emphasized the importance of maintaining a delicate balance between the rights of the accused and the rights of the victims, stating that the constitutional presumption of innocence until proven guilty must be respected, while also protecting the victims. The state claims that the alleged incidents took place in May of the current year, with additional accusations of sexually grooming the young girl between July and August.

Majavu explained that courts consider the possibility of threats against victims or witnesses, recognizing that interference with witnesses undermines the rule of law and erodes public trust in the judicial system. Sibiya was subsequently transferred to Kgosi Mampuru Prison due to concerns about witness intimidation. During state prosecutor's testimony, it was alleged that there is a network of individuals allegedly working in concert with Sibiya, making it difficult to apprehend him due to threats against witnesses and victims.
