Tamil Nadu woman's ‘nude photos’, late-night calls cost her child custody

In a recent ruling, the Madras High Court has denied custody of two children, aged seven and nine, to a woman from Ooty. The court cited her admission of sending "nude and semi-nude photographs" to another man, as well as having "late-night calls and video calls" with him prior to separating from her husband. The court argued that the minors, still in an impressionable age, would be adversely affected by their mother's conduct, as it would hinder their understanding of moral and ethical behavior.

The bench of Justices PT Asha and N Mala also referenced literature, including poetry by the Sufi poet Rumi and Lebanese-American author Khalil Gibran, to emphasize the importance of a mother's pure and exalting love for her child. The court upheld an earlier order from a local family court that denied custody, stating that the mother had failed to fulfill her duty and responsibility as a mother.

The case arose when her husband discovered incriminating texts and explicit images on her phone in 2023, leading him to end their cohabitation six days later. The children have been staying with their father since then. The woman had filed a petition seeking custody, but the High Court concluded that her actions did not align with the best interests of her children, who needed a mother who upheld their moral and religious upbringing.
