Girl with cerebral palsy in Shah Alam loses RM1m suit over school chair-pulling incident, family to appeal

On September 18, the High Court in Shah Alam dismissed a RM1 million civil suit filed by a teenager with cerebral palsy and her parents against six defendants for an incident that occurred in 2023. The girl fell after another student allegedly pulled her chair away, causing her injuries and suffering. Judicial Commissioner Datuk Anita Harun ruled that the plaintiffs did not prove the required negligence and causal link between the alleged supervision shortcomings and the injuries claimed.

The first defendant admitted to being the only teacher present, but the evidence did not establish that the supervision was unreasonable or that any reasonable precaution could have prevented the fall. The plaintiffs were ordered to pay RM10,000 in costs, while the defendants sought RM30,000. The family plans to appeal the decision, claiming that the court erred and that proper supervision should have been emphasized.
