Projekt von Juristen: Juristen-Handreichung gegen AfD-Pläne in Sachsen-Anhalt

A group of jurists has produced a practical handbook to help individuals with migration backgrounds and others potentially affected by a shift in policy in Saxony-Anhalt find appropriate actions. The handbook aims to provide legal assessments and case studies to defend against discriminatory or unlawful decisions by a new regional government.

The project, called "Recht Solidarisch - Juristische Orientierungen für die Zivilgesellschaft," is led by the Republican Lawyers Association (RAV), the Rosa Luxemburg Foundation, the Fraktionsvorsitzendenkonferenz of the Die Linke party, and the Equal Rights Beyond Borders association. The authors want to encourage individuals to file objections and, if necessary, take legal action against decisions such as "baby-birthday money" only for Germans.

A family without German citizenship, living in Saxony-Anhalt for years, working, and having indefinite residence status, would be disadvantaged. The jurists argue that citizenship should not be used as a criterion for family benefits. The AfD's election program states that the prerequisite for membership is German citizenship for at least one parent and a permanent home address for both parents in Saxony-Anhalt for at least a year.

The AfD has announced that an AfD-led regional government would house asylum seekers in central accommodations. Separate classes for children of refugees would only be legally valid if they prepare for transitioning to the regular class. Without a specific perspective, parents should lodge a complaint with the state school office against the school administration's placement decision.

The authors emphasize that citizenship law does not allow for a "sentiment test." The 25% quota for gymnasium enrollment is excessive and limits educational and life opportunities. If the AfD's plans are rejected, parents have the right to appeal. If unsuccessful, they could initiate a compulsory lawsuit before the administrative court.

The legality of the AfD's plans has been a topic of legal debates involving various experts, mostly concerning public administration law, constitutional protection, justice, or police matters. However, the jurists' publication also provides information on contact points where affected individuals can receive support and hints for non-governmental organizations concerned about the withdrawal of already approved subsidies.
