MACC officer retracts police report against Muhyiddin’s lawyer; court decides not to cite for contempt

The High Court in Kuala Lumpur decided not to initiate contempt proceedings against Malaysian Anti-Corruption Commission (MACC) officer Mazery Mohd Zaini today. This decision was based on the officer's explanation regarding his MACC colleague's police report, which accused former Prime Minister Tan Sri Muhyiddin Yassin's lawyer, Datuk Amer Hamzah Arshad, of contempt of court.

Muhyiddin's legal team had accused Mazery of contempt due to his actions that led to the police report, claiming he was still testifying as the 29th prosecution witness in the trial and should not have communicated with anyone, including the MACC colleague who lodged the report. High Court judge Noor Ruwena Md Nurdin accepted Mazery's explanation that he wanted to ensure there was no information leak from MACC itself.

She stated that while Mazery's actions were "overly-cautious," she accepted his explanation and decided not to proceed with contempt proceedings.

Mazery had testified earlier in the trial and was scheduled to continue his testimony, but the police report was lodged by his MACC colleague the previous night. Former Prime Minister Muhyiddin Yassin's lawyers accused Mazery of contempt due to the report, which they considered an "intimidation" tactic against their client's lawyers. The police report named Amer as having presented a classified document to the court, stating it was obtained from Adam Radlan Adam Muhammad's statement to MACC during investigations.

Although Muhyiddin's lawyers did not obtain the document through illegal or improper methods, Amer insisted that the trial was under threat by the police report. Mazery later apologized to Muhyiddin's legal team and confirmed that the police report had been given a "No Further Action" (NFA) status. He expressed hope that Amer would accept his apology.
