AGC: Diesel subsidy cuts not subject to judicial review

The Attorney General's Chambers (AGC) has argued against a judicial review application brought by two individuals who sought to challenge the government's withdrawal and focus on diesel subsidies in Peninsular Malaysia. Senior Federal Counsel Mohammad Salehuddin Md Ali stated that as the decision was not made under any written law, it falls outside the purview of judicial review.

The application, filed on October 7, 2024, by Azhani Marlan and Mohd Hatta Sanuri, accused the government's decision of being irrational, unreasonable, and unfair, as it excluded Sabah, Sarawak, and Labuan from the subsidy scheme. Counsel for the applicants argued that the matter is not academic, as diesel subsidies have been restored in Peninsular Malaysia in stages, but counsel for the respondents contended that the issue is now academic due to the nationwide standardization of diesel prices and subsidies from July 1 of the current year.
