Public urged to draft Wills

A senior official at the Master of the Durban High Court, Phumelele Shamase, has urged the public to draft Wills, emphasizing that it is not only for the wealthy but for anyone with assets and dependents. This advice comes ahead of National Wills Week, an initiative led by the Department of Justice, the Law Society of South Africa, and Legal Aid South Africa, among other stakeholders. The week kicks off today, offering legal practitioners to provide free advice on estate planning and drafting Wills.

During the week-long event, scheduled from September 14th to 18th, 2026, individuals can visit attorneys or Legal Aid offices to receive assistance. Shamase highlighted the importance of having a Will, stating it empowers individuals to make decisions about their assets after death. She noted that not having a Will can lead to conflicts among family members and an extended, contentious process, as the law dictates the distribution of assets. Having a Will, however, simplifies the process for executors and heirs.

Shamase stressed the value of drafting a Will early to prevent complications post-death. She explained that when a person dies without a Will, the law decides the fate of their assets, often leading to family disputes and a prolonged, contentious estate administration. In contrast, having a Will ensures that the individual's wishes are respected, making the process smoother for executors and heirs alike.
