‘Man’s income Rs 1.5 lakh’: MP High Court cancels Rs 30,000 monthly support for wife

The Madhya Pradesh High Court has overturned a family court ruling granting a woman Rs 30,000 in monthly maintenance from June 1, 2025, citing the court's failure to properly evaluate her husband's assessed income of Rs 1.5 lakh and his refusal to submit salary documents. The court ruled that since the husband's income had already been calculated at Rs 1.5 lakh, it should have either obtained his salary documents or imposed an adverse inference against him for not providing them.

The woman and her husband married on June 17, 2019, and have been living apart since January 16, 2020. She initially claimed Rs 10,000 in maintenance under the Domestic Violence Act, later revealing she was already receiving it. The family court dismissed her interim maintenance request, and after her evidence was accepted on September 22, 2025, the high court ordered the monthly maintenance on September 8.
