Hakam kritik gesaan Hadi mansuh ‘undang-undang era penjajah’

Persatuan Hak Asasi Manusia Kebangsaan (Hakam) has criticized PAS President Abdul Hadi Awang for urging the annulment of all colonial-era laws, which he believes obstruct Islam's ability to overcome man-made laws. Hakam President M Ramachelvam expressed particular concern over the use of colonial-era legal arguments to portray the Malaysian constitutional framework as an imposed foreign imposition inherited from the past.

He questioned whether the limitations on Shariah powers were merely a "colonial" constraint to be abolished.

Ramachelvam asked whether a law's historical links to colonialism mattered more than its constitutionality in today's Malaysia. He argued that the Reid Commission was established to draft a constitutional framework for the self-governing, independent Federation of Malaya, following consultations with political parties, public representatives, and Malay rulers. The resulting constitution formed the basis of the parliamentary system chosen and ultimately adopted when independence was achieved.

The President of Hakam stressed that the federal government and the national and religious courts, as well as the civil and Shariah courts, are defined under the constitutional framework, with Islam recognized as the federal religion. He emphasized that laws could be amended or annulled, but such changes must be justified based on the merits of the legislation and its constitutional structure, not solely on narratives of the colonial vs. Shariah struggle.

Political leaders, he said, have a profound responsibility to ensure public discourse on fundamental issues like religion, law, and constitutional rights does not fuel fear, hatred, or mistrust among the populace.
