Court upholds ban on retired Presidents holding political party office

The High Court in Nairobi, Kenya, has upheld a law limiting retired presidents to six months of political party office after leaving the presidency, dismissing a constitutional challenge to the law. The petition, filed by three individuals, argued that the provision violated constitutional rights to political participation and equality.

However, the court rejected the claim, stating that retired presidents are a distinct category due to their unique constitutional status, benefits, and influence. The court found that the six-month restriction does not constitute unfair discrimination under Article 27 of the Constitution and is necessary to safeguard democratic governance and prevent state capture by former heads of state.

The ruling maintains the existing prohibition on retired presidents holding leadership positions in political parties beyond the six-month period, while still allowing them to participate in political activities and contribute to the government in other ways.
