Islamabad High Court Stops Action Against Legally Operating Sheesha Cafes

The Islamabad High Court has issued a directive stating that it will not permit the enforcement of any coercive or unlawful actions against sheesha cafes and restaurants that are operating within the bounds of the law. Simultaneously, the court has directed the Islamabad Police to maintain stringent enforcement against illicit sheesha cafes and businesses that are found to be in violation of the law or the permit requirements.

Moreover, the IHC has requested a response from the federal government, and has mandated the authorities to finalize and implement regulations governing sheesha cafes within a month's time. The court has further mandated that the federal cabinet must approve the pertinent laws concerning restrictions on sheesha smoking as soon as possible. The Advocate General of Islamabad and the Additional Attorney General have been asked to take up the matter with the relevant authorities.

During the court proceedings, the court emphasized that it is the government's responsibility to safeguard the younger generation from the dangers of drugs and sheesha smoking. The court also expressed its concern over the lack of a proper legal framework for sheesha cafes. The authorities have been instructed to finalize the rules within a month and submit a compliance report to the court.

The Anti-Narcotics Force (ANF) has been directed to collaborate with the Islamabad Police in their efforts to eradicate drugs from the community.

The court emphasized that establishments that are operating legally, such as restaurants, should not face any unlawful action. However, strict legal action should be taken if a business is found to be in violation of the law or the conditions of its permit. The IHC also ordered all related petitions to be consolidated and adjourned the hearing until October 13.
