Young woman’s jail term for fatal stabbing doubled to 12 years

In a recent decision, the Court of Appeal has doubled the prison sentence of a young woman who fatally stabbed her boyfriend at a hotel in Johor in 2022. The original sentence of six years and six months was increased to 12 years, as the Court believed the original sentence did not adequately reflect the gravity of the crime. The case involved a 19-year-old woman, identified as Shy, who had been in a relationship with her 29-year-old boyfriend for almost a year.

The argument over sexual matters led to an altercation in which Shy refused to have sex with him, stating she was menstruating. He then threatened her with a knife, and in the ensuing struggle, she stabbed him multiple times in the chest. An autopsy revealed 28 injuries, with multiple stab wounds to the chest being the cause of death.

The Court noted that the High Court had been overly sympathetic towards Shy's age and had placed insufficient weight on the severity of the killing. The Court of Appeal also rejected the idea that Shy's loss of youthful offender status should be considered a mitigating factor, as she was 22 at the time of her conviction. The appellate court emphasized that the sentence must be proportionate and necessary in the public interest, taking into account the multiple injuries, the use of a knife, and the loss of the boyfriend's life. The 12-year sentence was deemed appropriate and was to take effect from the date of Shy's arrest.
