The Falklands/Malvinas dispute: Javier Milei tightens sanctions against companies drilling for oil on islands

Buenos Aires, Argentina - President Javier Milei of Argentina recently announced a set of measures aimed at penalizing companies operating in the hydrocarbon sector on the Falkland/Malvinas Islands without Argentine authorization. These actions come in response to US President Donald Trump's neutral stance on the longstanding dispute between Argentina and the United Kingdom over the archipelago.

Milei has reaffirmed Argentina's claim to sovereignty over the Falkland Islands, which are currently occupied by the United Kingdom. In a televised address, Milei introduced a draft bill, titled the Law on the Defense of National Sovereignty, to amend Law 26,659 and impose stricter sanctions on companies engaged in hydrocarbon extraction or related activities on the islands.

These sanctions will extend to shareholders, CEOs, and suppliers involved in the sector. Milei emphasized that any argument based on referendums held in the Islands is invalid, stating firmly, "Las Malvinas son argentinas." In addition to the bill, Milei plans to sign an emergency decree to bolster military and telecommunications resources at a naval base in Tierra del Fuego, a facility that started construction in 2022 during the Alberto Fernández administration.

The bill also requires hydrocarbon companies to sign sworn declarations of "sovereign compliance" to access the Regime for Large Investments (RIGI), a tax incentive program advocated by Milei to attract foreign investment. The Argentine Foreign Ministry stated that it will initiate legal proceedings against 45 individuals and companies for alleged violations related to hydrocarbon exploration on the islands.

Despite Milei's announcement, the opposition in Argentina questions the transparency of the measures and criticizes the president for his admiration of Margaret Thatcher and his support for the US President Donald Trump. The US President criticized Britain's distance, stating that it is too far away and criticized Britain for not backing the US in the Iran war.

Several oil companies, including SLB, Halliburton, and Baker Hughes, stated that they will not conduct business with companies involved in the Sea Lion project in the Falklands, in order to respect Argentina's sovereignty over the islands and avoid participating in the operations of the "Kelpers."
