European Country Bans Hijab in Schools

Austria has enacted legislation prohibiting headscarves and other traditional Muslim head coverings for girls under 14 in schools as the new school year commences. The prohibition applies to both public and private institutions and has been met with criticism from Muslim groups, political opponents, and certain educators. Carla Amina Baghajati, representing Austria's Islamic Religious Community (IGGÖ), firmly opposes the law, contending that it infringes upon religious liberty and disproportionately impacts Muslim girls.

The organization plans to back legal challenges by impacted girls and their families, including proceedings before Austria’s Constitutional Court. This potential legal action could be significant due to the Constitutional Court previously invalidating a previous headscarf ban in primary schools in 2020, declaring it contravened the principle of religious neutrality.

Going forward, educators must handle situations where students wear headscarves. This process commences with dialogues between the student and their legal guardians. Persistent breaches could result in reporting to child services, while guardians might face fines up to €800. Certain instructors have voiced disapproval of the regulation, asserting it imposes an extra enforcement obligation on schools.

The opposition Green Party has accused the government of instigating fresh disputes and essentially mandating teachers to assume a policing role. Austria's legislation diverges from France’s prohibitions on religious symbols in schools because the new measure explicitly targets Muslim head coverings worn by girls under 14.
